Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.

In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The court proceedings involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing trial in Tennessee.

Terms of Release

The judge, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
